# FUSE Copyright / DMCA
The FUSE software platform and related materials are provided by **IT Project Pros, Inc., doing business as FUSEONai** ("FUSEONai").
## 1. Copyright and Intellectual Property

IT Project Pros, Inc. owns the applicable copyrights and other intellectual-property rights associated with FUSEONai and FUSE, including protected software, written materials, methodology, documentation, designs, workflows, templates, graphics, and other original content, subject to any identified third-party rights.
No license or right is granted except as expressly provided in an applicable written agreement.
Customer ownership of Customer Data does not transfer ownership of the underlying FUSE software, methodology, framework, templates, reusable components, or other FUSEONai intellectual property.
## 2. Trademarks
FUSEONai and FUSE are trademarks of IT Project Pros, Inc.
No person may use FUSEONai or FUSE names, marks, logos, or confusingly similar designations in a way that falsely suggests sponsorship, affiliation, authorization, or endorsement.
Trademark symbols should reflect the actual registration status of each mark. Do not use the registered trademark symbol unless the applicable mark is registered for the relevant goods or services.
## 3. Customer and User Content
Customers are responsible for ensuring that content they upload, store, transmit, or use through FUSE does not infringe copyright or other intellectual-property rights.
FUSEONai may remove or disable access to material when required by law, a valid court order, or an effective notice under the Digital Millennium Copyright Act ("DMCA").
## 4. DMCA Designated Agent
IT Project Pros, Inc. has registered a designated agent with the U.S. Copyright Office to receive notifications of claimed copyright infringement.
Notices of claimed copyright infringement should be sent to:

## 5. Notice of Claimed Copyright Infringement
A copyright owner or a person authorized to act on the owner's behalf may submit a written notice of claimed infringement to the DMCA Designated Agent.
To be effective under the DMCA, the notice should include substantially the following:
1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed or, if multiple works at a single site are covered, a representative list.
3. Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient to permit FUSEONai to locate the material.
4. Information reasonably sufficient to permit FUSEONai to contact the complaining party, such as an address, telephone number, and email address if available.
5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed.
Notices should be sent to the DMCA Designated Agent identified above.
## 6. Response to a Valid Notice
When FUSEONai receives an effective notice of claimed infringement concerning material stored at the direction of a user, FUSEONai may act expeditiously to remove or disable access to the identified material as appropriate.
Where required by the DMCA, FUSEONai will take reasonable steps to notify the affected customer or user.
Removal or disabling of access does not constitute an admission by FUSEONai that infringement occurred.
## 7. Counter-Notification
If a customer or user believes material was removed or disabled as a result of mistake or misidentification, the customer or user may submit a written counter-notification to the DMCA Designated Agent.
To be effective under the DMCA, the counter-notification should include substantially the following:
1. The subscriber's physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
3. A statement under penalty of perjury that the subscriber has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. The subscriber's name, address, and telephone number.
5. A statement that the subscriber consents to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. § 512(g)(3), and that the subscriber will accept service of process from the person who submitted the original notice or that person's agent.
## 8. Restoration Following Counter-Notification
After receiving an effective counter-notification, FUSEONai may provide a copy to the person who submitted the original infringement notice and inform that person that FUSEONai may restore the material or cease disabling access.
Subject to the DMCA, FUSEONai may restore the material not less than ten (10) and not more than fourteen (14) business days after receiving the counter-notification unless the Designated Agent first receives notice that the original complaining party has filed an action seeking a court order restraining the subscriber from engaging in the allegedly infringing activity.
## 9. Repeat-Infringer Policy
FUSEONai has adopted a policy that provides for termination, in appropriate circumstances, of subscribers or account holders who are repeat copyright infringers.
FUSEONai may consider the facts and circumstances of each matter, including valid notices received, counter-notifications, court orders, evidence of infringement, and the user's conduct.
Customers and Authorized Users are informed through this notice and the FUSE SaaS Agreement that repeated infringement may result in account suspension or termination.
## 10. Misrepresentations
Knowingly making a material misrepresentation in a DMCA infringement notice or counter-notification may result in liability under applicable law.
A person submitting a notice or counter-notification should ensure that the submission is accurate and legally supportable.
## 11. Other Intellectual-Property Complaints
This DMCA process is intended for copyright complaints.

This Copyright / DMCA notice and the DMCA Designated Agent contact information must remain available from a publicly accessible FUSE or FUSEONai web page.
User login must not be required to locate the DMCA Designated Agent information.
